Resolution.....finally
This is a case I worked when i was still working for the state. I have been waiting to see the outcome, whether it would go to trial or not. I'm glad to see a resolution although my heart still hurts for the baby.

Mom pleads guilty
By Lindsay Slater
The Times-Journal

Published April 30, 2009

A tearful DeKalb County mother pleaded guilty Thursday to the manslaughter of her 5-week-old son.

Lindsey Jackson, a 25-year-old mother of three, received a 20-year sentence after pleading guilty to a lesser charge of manslaughter. She was indicted on capital murder charges more than a year ago. If convicted of capital murder, she could have faced the death penalty. She originally pleaded not guilty.

She will serve her sentence at the Julia Tutwiler Prison for Women in Wetumpka.

Jackson entered the courtroom of Circuit Judge Randall Cole around 10:45 a.m. with her attorneys Dana Grimes and Suzanne Bailey.

Her mother, Donna Nixon, Jackson’s husband and brother sat quietly in the courtroom.

Cole accepted Jackson’s plea.

In a letter to the court, Jackson apologized.

“I did a horrible thing,” Jackson said in the letter, which was read by Grimes. “I take full blame for it or I would not of turned myself in.”

In the letter, Jackson asked Cole for a lighter sentence to be able to be a mother to her three children, ages 4, 6 and 7.

“I’m not saying I don’t deserve to go to prison, but that you would lower my sentence to at least 15 years,” Jackson said in the letter. “Please give me the chance to raise them before they are too grown up.”

Cole denied the request but did reduce the sentence by 449 days, the amount of time she has been in the DeKalb County jail since being arrested Dec. 6, 2007.

Nixon said she is heartbroken and believes her daughter is innocent.

“I’m just so hurt,” Nixon said. “I don’t agree that she should have pleaded guilty.”

Nixon said her daughter is a good mother and had shown signs of depression before the incident.

Her mother still supports her daughter.

“I’m going to help raise her kids, go see her every month and pray that the Lord will take care of her,” Nixon said.

Deputy District Attorney Bob Johnston said the infant died of blunt force trauma.

“The findings from the forensic report from the state pathologist indicated that a single traumatic event led to Denny’s death,” Johnston said.

District Attorney Mike O’Dell said a meeting with Jackson prompted the lesser charge.

“After months of investigation, interviews and a thorough review of all the facts and circumstances surrounding the child’s death, we are confident that the events that led to the death of Denny Jackson were born out of poverty and ignorance, but not malice,” O’Dell said. “Capital murder involving an infant is a charge reserved for intentional infanticide. I believe that 20 years in prison for manslaughter is punishment that fits this crime.”

Special Investigator Rhonda Jackson, who served as lead investigator, agreed .

“I do not believe that Lindsey Jackson intended to kill her child when she struck him,” Jackson said. “She lost control and committed a horribly tragic act on little Denny. She will have 20 years in the penitentiary to ponder and relive those last moments of her son’s life.”

O’Dell said he believes the punishment is appropriate.

“Lindsey Jackson sat across from my desk and, sobbing, detailed for us what had transpired at the time of her son’s fatal blow,” O’Dell said. “Her account was consistent with everything we had learned over these many months and confirmed to me that a manslaughter plea was the appropriate course of action. I hope and pray that someday, Lindsey will be able to forgive herself for what she did to Denny.”

Busy Busy Busy
Well there are a lot of things going on! I found out that i am going to be teaching this summer. I'm on schedule to teach the intro to criminal justice class in summer c, starting 29 june. So I've been busy trying to decide which textbook i'm going to use. I've got a few samples on the way to look at so i should know pretty soon which one I want. I'm excited but also nervous.

I'm also still working on my area paper and really need to get on the ball. Luckily i'm great at procrastination!

As most of you know, on 7 March 2009, I lost my father to cancer. He had been sick only a very short time, losing his battle only 11 days after getting his 'official' diagnosis. I can only find solice in the fact that he is no longer suffering and will spend the rest of eternity drinking coffee and telling stories in a garage that never needs cleaning ! He will also have a 'honey do' list that never needs finishing

I wanna say thanks to everyone for all the good wishes and the support. And to Jen Brown and Carol Spackman, Thanks for the flowers. They were beautiful! I've posted pictures. My family appreciated all the good thoughts.
